Can the VA take away your 100% Permanent and Total Disability? Yes, They Can
The 100% Permanent and Total Disability is the only benefit that allows for a veteran to be paid at the 100% rate. It also provides exemption from having to pay copays or co-insurance when utilizing facilities outside of VA control.
If you have been paid at 100% P&T for a few years, and the VA has determined that your disability was not as severe as it once considered it to be, they will issue a proposed reduction letter.
Prior to reducing a disability rating, the VA must provide you with a written notice of the proposed reduction. When the VA fails to follow the rules and regulations when proposing a reduction, the reduction is void and unlawful.
The VA must first issue a notice of proposed reduction if they believe your disability rating warrants reduction.
The first notice gives you 60 days to submit evidence that your condition has not improved. Within 30 days of receiving the notice, you can request a pre-determination hearing. If you request a hearing, you WILL have more time to submit evidence.
