How does the VA Disability 55 Year Old Rule work for disabled veterans? Once veterans reach 55, they are exempt from periodic future examinations, except when the VA violates the rule, which happens more often than you think!
According to the VA Adjudication Procedures Manual, veterans over 55 years old are supposed to have protected VA disability ratings. This means the VA can not reduce a veteran’s disability rating unless there is clear and unmistakable evidence that the veteran’s condition has improved.
Despite this rule, the VA routinely violates the VA Disability 55 Year Old Rule by ordering examinations for veterans over 55 and then reducing their VA disability rating based on the results of these exams.
