Veterans across the country are feeling angry and misled after learning that the US Department of Veterans Affairs has been using a sneaky trick to take away their benefits—the VA 10 year rule. The VA’s 10-year rule states that if a veteran’s disability has been in place for at least ten years, the VA cannot terminate service connection for that disability.
However, what many veterans are unaware of is that this 10-year rule is not only used to protect veterans’ benefits; it is also being used by the VA to take them away. In some cases, a veteran will be approved for service connected disability benefits which then become permanent after 10 years—even if their condition has improved. The VA then reduces or terminates the veteran’s benefits, even though they still have a service-connected disability.
This deceptive practice has caused distress and confusion among veterans—many of whom believed that once they were approved for benefits, those benefits would be guaranteed for life. Unfortunately, this is not the case due to the VA’s 10-year rule.
