Ah, VA Benefits. The VA Disability Rating system can be confusing and hard to navigate. If you know that the VA got it wrong and your VA Rating Decision is incorrect – don’t despair! You do have the right to appeal a VA decision or rating – sometimes even when the VA says you don’t. Let’s explore how you can go about doing this without going completely bonkers.
First things first- Build your case! Gather all of your medical records and evidence related to your claim before getting started. It’s important to make sure every piece of information is organized and ready for review. This includes any medical reports from private doctors, as well as military medical records (even if they’re old).
Next, you’ll need to decide if you’re going to take it all the way to VA or just file for an increase of VA disability rating. You can always request a hearing with the VA if it doesn’t make a decision within one year from when you filed your claim. This is called “appealing a VA Rating Decision” and involves having a VA Representative review your dispute.
You will also want to determine which avenue of appeal is best for you: direct review, regional office, board of appeals or court system. The VA has specific rules for each type of case so be sure that you read up before making your decision.
Finally, don’t forget that even after you file your VA appeal– you still need to follow up with the VA. Check in on your case regularly and make sure they know that you’re serious about getting it handled. Don’t be afraid to give them a call and remind them of how important this is to you!
With all that being said, remember – VA Benefits are there for veterans and their families who have made sacrifices protecting our country. So don’t let a VA Rating Decision dishearten you or stop you from appealing it if needed. You can do this! Good luck!
