Getting a protected VA disability rating can be like winning the lottery for veterans, but only if you know what it entails. Protected ratings are exactly what they sound like: your VA disability rating is protected and cannot be reduced or revoked by the VA in the future. But when does this protection start?
The answer depends on which type of protected VA disability rating you have been awarded. For instance, any VA disability rating that has remained at the same level for five years or longer is considered stabilized. Another example is the VA disability 10-year-rule . Under this rule, the VA cannot reduce or eliminate a disability rating that has been in place for 10 years or longer unless there is substantial medical evidence suggesting steady improvement of the veteran’s condition over time.
It’s not all roses and sunshine, however. Protected VA disability ratings can be revoked or reduced in most circumstances and the exception is the Va’s 20-year-rule. This rule states that after 20 years, a veteran’s disability rating can no longer be changed or revoked by the VA. This means that you are finally able to enjoy the peace of mind knowing your VA disability rating will stay in place for years to come.
